So when looking for a law firm, I was unsure about what type of firm I needed. Well, I&#8217;m mostly just a plaintiff for Microsoft, while the rest is mostly defense work. So I&#8217;ve come to the conclusion that I need a good defense firm. Right now,  I&#8217;m looking at one of the largest defense firms in the country. I don&#8217;t know if they&#8217;ll accept my case, but I will probably try to hire them. They have lots of experience in all the types of cases I&#8217;ll be faced with. I really like that they defend people in defamation and First Amendment litigation. They also do &#8220;Crisis Management&#8221; where they utilize &#8220;crisis response teams to mitigate reputational damage and manage high-stakes public narratives&#8221;. That&#8217;s exactly what I need. The first movie may or may not have been about me, but I once tried to sue them for it anyway. Well, the next two movies were definitely made in response to my lawsuit and in retaliation for it, so they used my &#8220;distinctive persona&#8221; to try to inflict IIED. &#8220;A persona encompasses the unique combination of traits, habits, voice, appearance, or catchphrases that immediately evoke that person in the minds of the public.&#8221; [L]iability for misappropriation is not limited to strict uses of a person&#8217;s formal name or photographic likeness. If the defendant&#8217;s depiction\u2014taken as a whole\u2014succeeds in commercializing and evoking the plaintiff&#8217;s unique identity without authorization, it constitutes an actionable appropriation of their distinctive persona.&#8221; Part of this tort involves the right to privacy, which &#8220;[p]rotects ordinary individuals against mental anguish, embarrassment, and unwanted public exposure caused by having their image exploited.&#8221; Box office revenue for the <em>Van Wilder <\/em>franchise is over $44 million.
