It&#8217;s easy to change your terms and conditions in<em> anticipation of a lawsuit<\/em> <em>that you  know is coming<\/em>. With the stroke of a pen they can write off all sorts of liability. That&#8217;s not the sort of action Microsoft should take, and it&#8217;s not really fair. I doubt it will hold up in court, given they have known all about this for over 20 years and are probably just using terms and conditions to try to write off liability when they already they have existing liability.<\/p>\n\n\n\n<p>My research tells me  that companies do try to use T&amp;Cs as a shield, but when they do it to dodge an existing, long-standing liability that they&#8217;ve known about for years, courts routinely call it out as unfair and refuse to uphold it.<\/p>\n\n\n\n<p>And they should forget forced arbitration especially if it was added later than the original terms and conditions that was in existence at the time that the liability started.
